ABSTRACT

It is argued in this study that Islamic law has elevated women and gives them a very dignified position, and that the western call for women’s liberation is actually a misrepresentation of the true nature of women, and that in fact it is a disguised form of exploitation of the women’s body, deprivation of their virtuousness, and degradation of their dignity. This study was conducted under the title: “An Appraisal of the Impact of Gender Equality on Women The research work is predicated on the issues that have arisen as a result of the severe criticisms that have been leveled against the Shariah, namely that it negates gender equality. This is especially the case due to the fact that women are not permitted to freely mingle with men and participate in a wide variety of endeavors in order to earn a living. The primary goal of this work, therefore, is to provide an evaluation on the impact of gender equality on women’s right to work in Islamic law in order to highlight the correlation between gender justice and applicable limitations to women’s right to work outside their matrimonial home in accordance with Islamic law. In other words, the main objective of this work is to provide an evaluation on the impact of gender equality on women’s right to work in Islamic law. It is argued that the “permissibility” that is the legal position of the right to work should not be allowed to overshadow the “obligatory responsibility” that is the primary duty of women, such as rearing children, caring for the home, and other similar responsibilities. This is because the primary duty of women is to take care of their families. It is consequently seen that there is an abdication by women of their obligations to children as a result of working outside of their married homes, and this is due to the fact that there is an increase in the number of working women. Additionally, it has been seen that she loses her femininity and her inclination toward purdah, both of which were designed to protect her physiology and morals. It is for this reason that it is recommended that in order to uphold the Islamic perspective of gender equality and to grant women the permission to work, it is pertinent that employers of labor, more particularly in places where Muslims are predominant, should endeavor to foster a gender sensitive atmosphere by providing gender segregated facilities such as toilets, staff common rooms, female traveling buses, female nurses and doctors for women, and other such things. This recommendation is made in light of the fact that in order to uphold the Islamic perspective of gender equality and to grant women This would make it possible to observe the Islamic tenet of purdah, according to which it is forbidden to keep the sexes apart and to mix them together. Additionally, it is recommended that a woman who works outside the home must respect her primary responsibility of rearing children and tending the home without having to create the additional problem of requiring somebody else to take care of them for her, as there is no more suitable person to discharge it than herself. This is because there is no one more suitable to discharge it than herself. In conclusion, it has been advised that Muslim women should stop trying to deceive Islamic morality in the name of employment by trying to imitate the ideals and values that are advocated for by western feminists. It is for this reason that
