ABSTRACT

One distinct branch of the overall criminal justice system is known as the Juvenile Justice System. It is anticipated that both the appearance and operation of the system will be suitable for use by children. The understanding that children are fragile and that exposing a child offender to the full weight of the criminal justice system would have a negative impact not only on the kid but also on society as a whole gives rise to the need of a justice system that is child-friendly. In contrast to the present trend, which places a greater emphasis on rehabilitation, reformation, and re-integration as the primary objective, Nigeria’s general criminal justice system, which also governs the country’s juvenile justice system, is punitive and promotes retribution. The difficulties that are faced by children have garnered the interest and attention of people all over the globe as a direct result of the significance that the world derives from the promotion and preservation of the rights of the child. As a consequence of this development, the administration of juvenile justice is no longer an issue that is only the purview of national governments. As a result, the justice system for juveniles in Nigeria has to be evaluated using the standards that have been established by the United Nations and any other continental or regional organizations. Throughout its history, Nigeria has been in the forefront of nations devoted to the cause of protecting the rights and welfare of children. In 1943, Nigeria passed a law called the Children and Young Persons Act, and a decade later, in 1958, the law was approved for use in Northern Nigeria. These rules were enacted long before any international mechanisms were created to protect the rights and well-being of children.
