ABSTRACT

The ECOWAS Treaty drafted in 1975 by the founding fathers of the West African Regional Integration Philosophy was amended in 1993 in light of regional and global events. The Economic Community of West African States (ECOWAS) is still the common partnership through which Member States strive to aggregate their shared ambition and desire for a flourishing United Economic Union in the sub-region of Africa.

Although exceedingly ambitious, the Integration instruments make no pretenses about the aims and aspirations they strive to realize in this globalized and competitive world. Due to the legacy of colonialism and the epileptic nature of the African economy, the coming together of African nations is often equated with the sharing of poverty. The divide-and-conquer approach of the West has caused African states to mistrust each other to the extent that Francophone West Africans are now skeptical of any step made by Anglophones on the Integration Ideology. Therefore, each state party does not want to sacrifice any of its sovereignty to the organization, but rather wishes to reap the full benefits of integration.

This thesis tries to highlight the Economic and Human Rights framework as enshrined in the ECOWAS Treaty, as well as the journey so far and the implementation of the community’s actions and decisions in Nigeria in particular. The research is introduced in the first chapter. The second chapter examines the definition of Treaty and the significance of Treaty as a source of international law. The third chapter of this dissertation discusses the meaning, nature, and extent of economic integration. Additionally, the chapter examines economic integration under the ECOWAS Treaty. The fourth chapter analyzes the framework for human rights under the ECOWAS Treaty. The fifth and final chapter provides a summary of the study and extensive recommendations for policymakers and ECOWAS Treaty implementers.

This thesis provides the reader with a convenient overview of current status and developments in the West African Integration agenda via ECOWAS, as well as the concerns, challenges, and future prospects of the Organization and the urge for greater commitments from State Parties to ECOWAS Programmes.
